In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. The settlement resolved a class action lawsuit filed over overdraft fees. According to the lawsuit, Bank of America engaged in practices which caused customers to overdraw their accounts more frequently. The bank settled the lawsuit for $35 million with an estimated payout of $78 per account.
As we explained in the original article, to claim the settlement, eligible customers needed to file online or mail in a claim form.
Nearly three years later I received my check and it was a nice surprise- $98.16. If you filed for the settlement award then look for a check in your mailbox over the next week.

I received a notice on the lawsuit against BOA in August of 2011. I did look online and the statement said some people was not happy with the settlement and it might take a year or two. It has been almost a year since the case was settled. Can anyone say how much longer? I am sure the attorney's have gotten paid most of the settlement anyway. My email is debbie.melendez23@yahoo.com. I was told I needed to do nothing to be a part of this settlement. Now I read that I needed to fillout a claim. Well thats just great. They got me for plenty of charges of $35.00. So now I get nothing??
This is bull. It said if you want to be a part of this do nothing, if not write and say you dont.

recieved a postcard about lawsuit in sept 2011. i didnt do anything. still haven't recieved any money or notices or anything else. on nov 11, it will be 1 year. could use my money....any money. they were wrong and set the money aside to repay a portion, let them repay what they are willing to pay...lawyers already took 123 million...where's my part? i want it now!!!!!!!!!!!!!!!

i feel the same way. "WHERE IS MY CHECK!!!!!!!!!!!!!!!!!" i am so sick of the same crap and different toilet it is a shame. just give me my "CHECK!" i need it in a really bad way

Got the postcard but never got the "check" Maybe its like the money our country is printing .... fiat and worthless ..... Do banks ever really give a refund or a "check"? only when they are taking all our money what a joke 10 years of BOA BS pipe dream -~
