Bank of America Overdraft Settlement Checks Begin to Arrive - $98.16

In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. Nearly three years later I received my check and it was a nice surprise- $98.16.

In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. The settlement resolved a class action lawsuit filed over overdraft fees. According to the lawsuit, Bank of America engaged in practices which caused customers to overdraw their accounts more frequently. The bank settled the lawsuit for $35 million with an estimated payout of $78 per account.

As we explained in the original article, to claim the settlement, eligible customers needed to file online or mail in a claim form.

Nearly three years later I received my check and it was a nice surprise- $98.16. If you filed for the settlement award then look for a check in your mailbox over the next week.

    I didn't received my check either. Don't know who to contact or what to do with this. We should all close our BoA accounts and send them a strong message. 9-10% is insulting.

    There are two lawsuits. One for debit card transactions that overdrew you which you had to file a claim for, this has been settled and paid. Then the other is for general overdraft fees which you had to do nothing on, this has been settled but appealed so its pending. The second one is more recent and could take a long time to be final.

    I have not received my check yet!!! I receive a postcard stating that i was in a lawsuit and did not have to do anything to get m y check.....well where is the check??????

    I havent received any news or postcard about the overdraft payment. Last i have they where still waiting for more situation that had came up. I had gotten mail telling me about it last year. Please let me know whats going on and how i can receive my check.

    Nobody received anything from BoA yet. There was an appeal filed
    By some people who didn't like the amount of the settlent
    (too small). The appeal could take up to 2 years
    Hang in !
