Bank of America Overdraft Settlement Checks Begin to Arrive - $98.16

In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. Nearly three years later I received my check and it was a nice surprise- $98.16.

In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. The settlement resolved a class action lawsuit filed over overdraft fees. According to the lawsuit, Bank of America engaged in practices which caused customers to overdraw their accounts more frequently. The bank settled the lawsuit for $35 million with an estimated payout of $78 per account.

As we explained in the original article, to claim the settlement, eligible customers needed to file online or mail in a claim form.

Nearly three years later I received my check and it was a nice surprise- $98.16. If you filed for the settlement award then look for a check in your mailbox over the next week.

    I just recieved my check for $30.92. No one will cash it and you can't even talk to anyone one the number to call. They owe me over $800!! This is crap!

    I just would like to know if there is a list of the people that got checks in the mail, and if so, can it be checked for my name? I am pretty sure that i should have or will get one but so far nothing ! Can you help ?

    Got my check about 3 weeks ago. there are no US Banks in my area and based on stuff I read here (thanks guys!) I wasn't sure where to go to cash it. I called BOA and they told me they would cash it. So, I went to BOA and they did cash it. They tried to tell me there was a fee involved because I was no longer a customer but in the end they said "No, there is no fee." That would have been ironic-charging a fee to cash a check that was given to someone because of fees...anyway, I am not complaining-it was more money then i had to start with so thanks BOA!!! :)

    I just received my 'postcard' check for $31.86. I thought it was a sick joke.. especially since in the year 2008 alone BofA charged me over $1,100 in Overdraft fees!

    I just wrote a nasty letter to RUST CONSULTING, INC. (the lawyers) because they got millions and left the people who deserve the money in the cold!
