Bank of America Overdraft Settlement Checks Begin to Arrive - $98.16

In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. Nearly three years later I received my check and it was a nice surprise- $98.16.

In January 2009, we wrote about a settlement reached with Bank of America called Closson et.al., v. Bank of America. The settlement resolved a class action lawsuit filed over overdraft fees. According to the lawsuit, Bank of America engaged in practices which caused customers to overdraw their accounts more frequently. The bank settled the lawsuit for $35 million with an estimated payout of $78 per account.

As we explained in the original article, to claim the settlement, eligible customers needed to file online or mail in a claim form.

Nearly three years later I received my check and it was a nice surprise- $98.16. If you filed for the settlement award then look for a check in your mailbox over the next week.

    Wow, if i would've known how much people are getting i would have extricated my self out of this litigation. I'm keeping my fingers crossed; hoping for a big $500.

    I received a check for $122. I remember getting notices concerning my old BoA account, but quickly dismissed them believing it was a scam. I knew BoA had been under a great deal of critism due to the $5 debit card fee fiasco. In 2008, my husband and I left BoA because of their practice of processing transactions in a manner that would cost much more money than we could afford to let go of. We signed up for overdraft protection to cover those times when a bill would be due and there could be a few days until our next DD. But we quickly figured out that it rarely benifited us and always benifited BoA. One fee that we knew we would be charged quickly spiraled into multple charges due to the way they processed transactions. I worked for a bank years ago. That bank always processed credits first then debits. And they always processed tranactions in the order that they came in. We, the customers, are paying for the growth of BoA. A bigger company means they have to pay more employees, more execs, more people to build more branches...etc. It takes money to make money. Unfortunately for us, we "pay" for their need to be one of the largest banks and for their need to make a crazy amount of money. Also, the group of people who filed the suit against BoA got their measley 9% credit plus a bonus dollar amount. So they probably did get back their fees and then some. I'm thankful for my $122 since I ignored the info regarding our old account, believing it was a scam to get personal info. My only regret is that $410 million is way to low of a settlement and BoA will continue to practice "robbing" their customers of their hard earned cash. this settlement was nothing for them. They learned no lesson. It was simply an inconvenience.

    Received a check for $103.96 ... at least I think it's a check. It came looking like an overdraft slip BoA sent to their customers back in the day that they knew were automatically ripped up and thrown away. Too bad I closed my account in disgust because of the way they screwed with it two years ago. So I opened it, and my eyes bugged open wide.

    But what bank is going to accept this postcard check? Heck, I almost didn't accept it.

    It was nice to find this in the mail after waiting 2 years. It completely slipped my mind and I almost threw it out, but luckily my brother got one too. It was funny because he told me don't bother, it was only a mere $7.50. I opened mine up and saw a check for $319. Even though I feel I should have gotten more, I'm happy with.

    I just got a check for a whopping $2.18. I would love to know how they calculated the awards because this is barely worth the paper it's typed on and a far cry from how much BofA cost me.

    I had BOA in highschool about 6 or 7 years ago, paid soooo much in overdraft fees it was crazy, and I was always good with my $$, and checked my acct daily, but they still somehow would have some bullshit excuse as to how a fee appeared, or why transactions were taken out in a different order than they were made.. either way, I never received anything regarding this case a year or so back, and never responded to anything-- and still got a check yesterday.. a whole $14.82!!! I'm so happy! This will get me MAYBE 3 gallons of gas in my tank!!
    THANK YOU BANK OF AMERICA. So happy I switched to a credit union a long time ago, bank of america sucks.

    I took my $98.16 check to US Bank (where the bank was cut) to cash it and US Bank would not cash it. Said there was a hold on their account and to call account holder.

    Still need an answer if I can cash this check that looks like a postcard? I don't use a bank ever since BoA screwed me out of hundreds of dollars! Has anyone had luck w/ just cashing it?
